Demand of money from employer

► Greetings, I have joined one company and worked there almost 2 month's. I could not continue there due to ongoing mental health issues and upcoming surgery that need attention. i inform them and ready to pay one month of basic pay as a compensation as part of not serving notice period in my probation period but they are demanding 1.6 lakh rupees as SLA breach. My salary was around 20 K there . Due to ongoing mental and physical battle , this causing me extreme anxiety and stress and I am unable to focus on anything. I don't know what to do as I can't pay such amount, which is not mention in any of my offer letter and can't handle there pressure. Kindly provide me guidance what to do or how to deal with it.

Dear client, as per your query, as the ₹1.6 lakh demand is not mentioned in your signed offer letter, it is not enforceable and is probably a threat. As per Section 74 of the Indian Contract Act, employers can only claim reasonable compensation for actual losses incurred (like particular training expenses), not arbitrary penalties. You should put in your resignation by email as you have a medical need for your surgery, provide one month’s notice pay as per your contract, and return all company property with acknowledgement. If the harassment continues or the required documents are not provided, you can file a complaint either through the CPGRAMS Portal or with the Labour Commissioner, as they cannot force you to pay any amount that is not mentioned in your contract.
