► मामले का संक्षिप्त विवरण (Advocate Brief) यह मामला मथुरा स्थित पैतृक संपत्ति से संबंधित है। 1. संबंधित व्यक्ति की यह दूसरी शादी है। 2. दूसरी शादी से एक 9 वर्षीय पुत्र/पुत्री है, जिसे Down Syndrome है। वर्तमान में उसकी प्राकृतिक अभिभावक (Natural Guardian) उसकी माता है। 3. पहली शादी से एक बड़ा पुत्र है, जिसे परिवार में पुत्र की तरह पाला गया, परंतु उसका विधिवत पंजीकृत दत्तक ग्रहण (Registered Adoption) नहीं हुआ है। 4. वर्ष 2021 में पैतृक संपत्ति का विधिक बंटवारा (Partition) हुआ, जिसमें पिता, दोनों पुत्रों (पति एवं उसके भाई) के हिस्से अलग-अलग दर्ज हुए। 5. बंटवारे के बाद पति ने अपने हिस्से की लगभग एक-तिहाई संपत्ति का विक्रय कर पंजीकृत विक्रय विलेख (Registered Sale Deed) करा दिया। 6. पति की नियमित आय का मुख्य स्रोत केवल पेंशन है। 7. प्रश्न यह है कि क्या उक्त विक्रय विलेख को चुनौती देकर घोषणा वाद (Declaration Suit) एवं आवश्यक होने पर विक्रय विलेख निरस्तीकरण (Cancellation of Sale Deed) का दावा, 9 वर्षीय दिव्यांग नाबालिग की माता द्वारा उसकी प्राकृतिक अभिभावक के रूप में किया जा सकता है। 8. साथ ही यह भी परीक्षण किया जाए कि नाबालिग के हित, भविष्य की आर्थिक सुरक्षा, भरण-पोषण एवं चिकित्सा आवश्यकताओं को ध्यान में रखते हुए कौन-कौन से वैधानिक उपाय उपलब्ध हैं तथा क्या अंतरिम निषेधाज्ञा (Interim Injunction) या अन्य संरक्षणात्मक राहत प्राप्त की जा सकती है। कृपया उपलब्ध सभी दस्तावेज़—पार्टिशन डीड/आदेश, राजस्व अभिलेख, विक्रय विलेख, परिवार का विवरण तथा बच्चे से संबंधित दस्तावेज़—का परीक्षण कर उपयुक्त कानूनी रणनीति बताने का कष्ट करें।यह सारांश आप किसी भी अधिवक्ता को प्रारंभिक ब्रीफ के रूप में दे सकते हैं।

A dispute to the registration of sale deed cannot be brought only based on the fact that the seller has a minor with Down Syndrome. The fact that after the 2021 partition the property becomes the separate possession of the husband would mean that he would have the legal power to dispose of the property, and there would be no right of birth in the self-owned property by the minor child. However, if there is any dispute about the partition, or if the sale was done beyond his legal rights or if the property was under any legal restrictions or in case there were any grounds for challenge like fraud, intimidation, or lack of authority, then the sale deed can be challenged. Apart from the dispute of the sale, it should be noted that the minor has the legal right to demand maintenance from the father, and suitable orders can be passed by the court keeping in view the nature of the disease and medical requirements.
