Dear Client,
If you the NBFC’s credit team is denying the payment and not issuing you any receipts and refusing to give you th NOC even though you had mad your payments promptly through the field team, you should immediately gather all the vidnces that support your claim of repayment including whatsapp chats, messages, call records, transaction history, details of th field executive and any such communication don with theem regarding the closure of the loan. The field team cannot harass you or your colleagues or references nor can they disclose your loan details to others legally; this will amount to serious breach of privacy policy and unfair recovery practice.
You should without any further delay contact the NBFC’s grievance redressal forum via mail or any other written format and inform them about your payment to the field team and the refusal of the credit team to acknowledge the same and denial to issue you NOC. And ask them to do the needful at the earliest. If they also deny the payment then you may approach the RBI Ombudsman, consumer forum or police/cyber authorities for harassment and wrongful recovery payments. Also kindly refrain from making any more payments to them without a written acknowledgement and propr loan statements from them.
I hope this helps and if you have any further issues do not hesitate to contact us.
Dear Client,
The core facts are alarming. You have paid the loan amount three times over, your accounts have been wrongfully reported, and now an RBI penalty of 1 lakh rupees has been imposed because you unknowingly transacted from a reported account. Every one of these is actionable.
Your most urgent step according to me is to compile a complete written timeline with all payment receipts, bank statements, email correspondence from both the field team and credit team, and any messages confirming the field team's collection. This documentation is the foundation of everything that follows. I will advise you to file a detailed complaint on the RBI's integrated ombudsman portal at cms.rbi.org.in against the NBFC, specifically citing that you have paid the loan amount multiple times through their own authorized field representatives, that no NOC has been issued despite full payment, that accounts have been wrongfully reported, and that the RBI penalty was imposed because of the NBFC's own failure to properly credit your payments and inform you of the account reporting. You shall moreover request the ombudsman to get the NBFC to issue the NOC and reverse the wrongful reporting, and also compensate you for all additional amounts paid.
About the 1 lakh rupees RBI penalty, if this has been imposed through a formal RBI communication, file a representation before the RBI Regional Office explaining that the transaction from the reported account was done unknowingly because the NBFC never properly notified you of the reporting, and that the NBFC's own internal mismanagement caused the entire situation. You are strongly advised to attach all evidence of payments made and the NBFC's contradictory communications.
I hope this helps, and if you have any further issues, do not hesitate to contact us.
