Dear Client, as per your query, Dealing with a spouse’s daily alcohol abuse and resulting quarrels is mentally and emotionally stressful. A Mutual Consent Divorce under Section 13B of the Hindu Marriage Act also requires that you and your husband agree on all terms and conditions of divorce, including alimony and child custody. Although this is the fastest way to get a divorce, it is important that you convince the court that your husband’s consent is genuine and not given while he is drunk or under pressure. Considering that you are having daily quarrels with your husband, you also have a valid ground to file a contested divorce on grounds of cruelty. Alternatively, you can also file a protection order against him under the Protection of Women from Domestic Violence Act, 2005. I hope this answer is helpful. Thank You.
