► I have purchased 25 boxes of tiles from a store and as agreed with the store owners if any of the box is not used then we can return them and they will return the money. I have returned the unused 5 boxes for which the return amount is 3050 and he has given the return slip with the mentioned amount rupee 3050 and he told to return the amount next day via UPI but he didn't return the amount. He further told that he will send his representative to my house and return the cash, I have shared the location, but his representative didn't come to home. Now it's been more than a month and amount is not yet returned. Can I raise a complaint against him?

Dear Client, you definitely can lodge a complaint as your case is clear and documented properly. You have a receipt from the shopkeeper who returned 5 boxes along with the amount that he has to pay you which is Rs. 3,050. This return receipt is a documentation of debt, and it is legally binding. The first step I would recommend is sending your latest communication through WhatsApp and SMS to the proprietor of the shop in which you clearly mention that you have issued a return slip for the amount of Rs. 3,050 on a certain date and giving them one week's time to make the payment.

If he does not pay, file a complaint before the District Consumer Disputes Redressal Commission under the Consumer Protection Act. The return of purchased goods and refund of the price is a service forming part of the purchase transaction, and the store owner's failure to honour the agreed return and refund is a clear deficiency in service and an unfair trade practice. Your return slip, the original purchase bill, and your communication records are more than sufficient evidence. File for the refund of Rs. 3,050 plus compensation for mental agony and harassment, and costs of litigation. Consumer courts have awarded compensation significantly exceeding the original disputed amount in cases involving deliberate non refund despite acknowledgement.

You can absolutely raise a complaint against the store owner for failure to refund the agreed amount even though the goods were returned unused along with a return slip of Rs.3050/-. Preserve all the documents such as the return slip, whatsapp messages and any other communication in connection to the refund as they are important evidence. Snd an official message, mail or legal notice demanding payment of the refund money, if no proper actions were taken then you can file a complaint under the appropriate consumer forum for deficiency of services.
