► I have a rent agreement with my tenant for 11 months which is already expired, now they are denying to increase the rent 5% as per contract and not ready to vacant the house. What to do?

Dear Client,

 

Your 11‑month agreement has expired, so the tenant is now on a month‑to‑month holdover tenancy, and you can either renew on new terms (including your 5% hike) or ask the tenant to vacate by giving proper notice. If the tenant refuses both the rent increase and to leave, you should first serve a written legal notice (usually 15–30 days, depending on local law and your agreement clause) clearly stating that the agreement is over, the new rent is ₹X, and that they must vacate by a specific date. If they still refuse, you can file an eviction or tenant‑recovery case before the Rent Authority or civil court in your state, which is the only legal way to force them out.
