► I'm filing a delayed payment claim under Section 18, MSMED Act 2006, but the ODR portal (https://odr.msme.gov.in) rejects my registration with: "Udyam record does not match with ODR record." Bangalore Urban MSEFC refuses to accept the hard copy, claiming they won't act on it without online filing and even if we send them via registered post . Does anyone have: Government circulars mandating hard copy acceptance when portal is down? Solutions to the Udyam-ODR mismatch error? SC/HC orders on this?

Dear client,

If your Section 18 MSMED claim was rejected by the ODR portal because of “Udyam record does not match ODR record,” it’s most likely due to a technical data issue rather than legally rejecting your claim.

 

The mismatch is the most common reason for the denial. The details on the Udyam registration files (name, pan, GST, and address) may not match exactly with the MSME and the ODR databases because the portal is very strict about that information having to be an exact match.

Confirm that:

Your name on the Udyam registration matches the name on your PAN or GST absolutely.

The Udyam registration number entered in the portal is correct.

The PAN linked to your Udyam registration is accurate and valid.

A mismatch may result from deregistration or old Udyam registrations — you have to update or revalidate your Udyam information or recreate your Udyam registration.

Concerning accepting hard copies of manual Section 18 Applications; there isn’t any overarching Government directive that instructs the MSEFC to accept manually submitted Section 18 Applications while the portal is down. The MSME Rules for Facilitation Councils 2016 state that electronic filing should be the principal avenue for filing Section 18 claims. Generally, hard copy claims should only be accepted if there are specific directives from the appropriate central ministry (and no such notice exists).

Some High Courts have ordered the facilitation councils to exercise flexibility regarding problems with the portal, but there has never been a blanket order from either the SC or HC to require the acceptance of hard copies of section 18 claims.

Dear Sir,

 

Send a single packet by registered post / speed post (with AD) to the MSEFC bench address (Bengaluru Urban) and also email the same documents to the MSEFC email + policy-division[at]dcmsme[dot]gov[dot]in and to the ODR helpdesk. Make sure the envelope and email contain:

Covering letter stating you attempted online filing on [date/time] and attaching screenshot(s) of the portal error. (Use the template below.)

Hard copy of the Section-18 application (petition) with exhibits and court fee (where applicable) — identical to what you would have uploaded. Include one set marked “For Registry / Record.”

Copy of updated Udyam certificate (pdf printout) and printout of the ODR error.

Proof of attempted filing — screenshots, portal error message, and sequence of steps used.

A request for written acknowledgment ask the MSEFC to “please acknowledge receipt and confirm acceptance/registration of this application in physical mode under the MSMED Act pending resolution of the portal error.”
